4. Shopify

Our online store is hosted and powered by Shopify.

Shopify provides the ecommerce platform that allows us to offer products and services to customers.

Your use of certain Shopify services, including accelerated checkout, Shop, or Shop Pay, may also be subject to Shopify’s applicable terms and privacy notices.

Shopify is an independent company and is not controlled by Trendy Best Gifts.

5. Customer Accounts

You may be permitted to create a customer account.

You agree to:

  • Provide accurate, current, and complete information;

  • Maintain the confidentiality of your login credentials;

  • Restrict unauthorized access to your account and devices;

  • Promptly update changed information; and

  • Notify us if you suspect unauthorized account activity.

You are responsible for activities conducted through your account to the extent permitted by law.

We may suspend or restrict an account when reasonably necessary to:

  • Protect the account owner;

  • Investigate suspected fraud;

  • Prevent unauthorized access;

  • Address a security threat;

  • Comply with law; or

  • Enforce these Terms.

We are not liable for losses caused by your failure to protect your credentials, except to the extent the loss results from our violation of applicable law or our legally actionable misconduct.

We make reasonable efforts to describe and display products accurately.

However, slight variations may occur because of:

  • Screen or device settings;

  • Lighting and photography;

  • Manufacturing processes;

  • Material availability;

  • Hand assembly;

  • Product customization;

  • Print placement;

  • Differences between production batches.

Colors, finishes, stones, fonts, graphics, message cards, packaging, and other visual elements may appear somewhat different in person than they appear online.

Photographs may include staging materials, props, enlarged details, or decorative objects that are not included unless specifically stated in the product description.

Product dimensions are approximate unless expressly identified as exact.

7. Message Cards and Emotional Content

Trendy Best Gifts offers products intended to communicate emotional, encouraging, sentimental, family-oriented, inspirational, or faith-related messages.

Message-card wording, product descriptions, blog articles, videos, social-media posts, and other content are provided for expressive, inspirational, entertainment, and general informational purposes.

This content is not intended as:

  • Medical advice;

  • Mental-health treatment;

  • Psychological counseling;

  • Legal advice;

  • Financial advice;

  • Religious instruction from an ordained or licensed authority; or

  • A substitute for professional services.

Customers should consult an appropriate qualified professional regarding individual medical, psychological, legal, financial, or other professional concerns.

8. Personalized and Made-to-Order Products

Many Trendy Best Gifts products may be personalized, printed, engraved, assembled, packaged, or produced after an order is submitted.

You are responsible for reviewing all information submitted with a personalized order, including:

  • Names;

  • Dates;

  • Photographs;

  • Messages;

  • Spelling;

  • Grammar;

  • Capitalization;

  • Punctuation;

  • Product style;

  • Necklace selection;

  • Message-card selection;

  • Gift-box selection;

  • Colors;

  • Sizes;

  • Quantities; and

  • Shipping information.

We are not responsible for errors contained in information submitted or approved by the customer.

Once production begins, a personalized or made-to-order product may not be changed or canceled.

Personalized and custom-made products may not be eligible for return or exchange unless:

  • The product arrives damaged;

  • The product is defective;

  • The wrong product was delivered;

  • The personalization differs materially from the information submitted or approved; or

  • Applicable law provides otherwise.

Return eligibility is governed by our Return and Refund Policy.

9. Customer-Supplied Photographs and Materials

When you submit a photograph, message, design, name, logo, or other material for customization, you represent that:

  • You own the material or have permission to use it;

  • Our use of the material to fulfill your order will not violate another person’s rights;

  • The material is not unlawful, threatening, defamatory, obscene, fraudulent, or harmful; and

  • The material does not contain malicious software or code.

You grant Trendy Best Gifts and its production providers a limited, nonexclusive license to use, reproduce, resize, format, print, engrave, or otherwise process the submitted material solely as reasonably necessary to:

  • Produce the requested product;

  • Fulfill the order;

  • Provide Customer Service;

  • Address quality concerns; and

  • Maintain legally required business records.

We are not required to accept every customization request.

We may reject a requested customization when we reasonably believe it:

  • Violates applicable law;

  • Infringes intellectual-property rights;

  • Promotes violence or unlawful conduct;

  • Contains hateful, threatening, or abusive content;

  • Contains sexually explicit content;

  • Creates a safety concern;

  • Violates another person’s privacy; or

  • Cannot reasonably be produced.

If we reject a paid customization before production, we will cancel the affected item and issue an appropriate refund.

10. Bulk Orders

Trendy Best Gifts may offer bulk ordering for businesses, organizations, churches, schools, nonprofits, events, corporate programs, celebrations, and other approved purposes.

Bulk-order terms may vary based on:

  • Product type;

  • Quantity;

  • Customization;

  • Packaging;

  • Production requirements;

  • Shipping destination;

  • Delivery schedule; and

  • Other requested services.

An inquiry, preliminary discussion, or estimate is not a binding agreement.

A bulk order becomes binding when:

  • We provide a final written quote, invoice, or order agreement;

  • The customer accepts it;

  • Any required design proof is approved; and

  • Any required payment or deposit is received.

Unless otherwise stated in the final written agreement:

  • Production will not begin before required payment and approval;

  • Deposits may become nonrefundable once production begins;

  • Custom bulk orders may not be returned or exchanged;

  • Changes after approval may result in additional charges or delays;

  • Delivery dates are estimates unless expressly guaranteed in writing; and

  • The customer is responsible for approving quantities, products, spelling, designs, addresses, and customization details.

If a separate written bulk-order agreement conflicts with these Terms, the separate written agreement controls for that bulk order.

11. Product Availability

Products may be available in limited quantities.

We may:

  • Add or discontinue products;

  • Modify product designs;

  • Change packaging;

  • Change available options;

  • Restrict quantities;

  • Limit sales to certain geographic regions;

  • Correct inventory errors; or

  • Withdraw an offer before accepting an order.

Placing an item in a shopping cart does not reserve that item or guarantee availability.

12. Orders and Acceptance

Submitting an order is an offer to purchase the selected products under these Terms.

An automated order-confirmation email confirms that we received the order. It does not necessarily mean that we have accepted, produced, or shipped the order.

We may review an order before accepting it.

We may lawfully decline, limit, hold, or cancel an order for legitimate reasons, including:

  • Product unavailability;

  • Incorrect pricing or product information;

  • Payment authorization failure;

  • Suspected fraud;

  • Unauthorized use of a payment method;

  • An invalid or incomplete shipping address;

  • Violation of purchase limits;

  • Suspected unauthorized resale;

  • A prohibited customization request;

  • A security concern;

  • A violation of these Terms; or

  • A legal or regulatory requirement.

When reasonably possible, we will notify you using the contact information submitted with the order.

If we cancel an order after payment has been collected, we will issue the appropriate refund to the original payment method.

13. Order Changes and Cancellations

Because many products are made to order, we begin processing orders as promptly as reasonably possible.

You may request a change or cancellation by contacting:

A request is not guaranteed to be approved.

An order generally cannot be changed or canceled after:

  • Production has begun;

  • Personalization has been completed;

  • The order has been transferred to a fulfillment provider;

  • A shipping label has been created; or

  • The order has shipped.

If a requested cancellation is approved, any refund will be issued according to the original payment method and applicable policies.

Nothing in this section limits cancellation rights that cannot legally be waived.

14. Prices

Prices are displayed in the currency shown on the Website or during checkout.

We may change product prices prospectively without notice.

A price change does not affect an order that we have already accepted, except when:

  • The price was displayed incorrectly;

  • A technical error occurred;

  • Fraud or unauthorized activity is suspected; or

  • Applicable law permits correction.

If a material pricing error affects an order, we may:

  • Contact you for instructions;

  • Offer the product at the corrected price; or

  • Cancel the affected item and issue a refund.

We will not charge the corrected price without your authorization when authorization is legally required.

15. Taxes, Duties, and Customs Charges

Applicable sales taxes may be calculated and collected during checkout.

For international orders, the customer may be responsible for:

  • Import duties;

  • Customs charges;

  • Brokerage fees;

  • Value-added taxes;

  • Local taxes; and

  • Other government-imposed charges.

Unless expressly stated during checkout, these charges are not included in the purchase price or shipping charge.

Trendy Best Gifts does not control charges imposed by foreign governments, customs authorities, carriers, or brokers.

Customers are responsible for complying with applicable import requirements.

16. Promotions and Discount Codes

From time to time, we may offer:

  • Discount codes;

  • Promotional prices;

  • Free-shipping offers;

  • Bundles;

  • Giveaways;

  • Limited-time promotions; or

  • Other special offers.

Promotions may be subject to:

  • Expiration dates;

  • Product exclusions;

  • Geographic restrictions;

  • Customer eligibility requirements;

  • Minimum purchase amounts;

  • Minimum quantities;

  • Usage limits;

  • One-use-per-customer limits;

  • Restrictions on combining offers; and

  • Other disclosed conditions.

Unless expressly stated otherwise:

  • Discount codes have no cash value;

  • Discount codes cannot be exchanged for cash;

  • Expired codes will not be accepted;

  • Discounts cannot be applied retroactively;

  • Only one discount code may be used per order; and

  • Promotions do not apply to bulk orders, gift cards, or previously completed purchases.

We may correct, suspend, or cancel a promotion if it contains an error, is used fraudulently, or is subject to abuse.

Material promotional restrictions will be disclosed with the applicable offer.

17. Payment

You agree to provide current, accurate, and complete billing and payment information.

By submitting a payment method, you represent that:

  • You are authorized to use it;

  • The billing information is accurate;

  • You authorize the applicable charges; and

  • You will pay all charges associated with the accepted order.

Payments may be processed by Shopify, Shop Pay, card networks, banks, digital-wallet providers, financing services, or other third-party payment processors.

Those providers may apply their own terms and privacy policies.

We do not ordinarily receive or store complete payment-card numbers.

Payment authorization does not guarantee order acceptance.

18. Fraud Prevention

We and our service providers may use fraud-prevention tools to evaluate orders and transactions.

An order may be reviewed, delayed, limited, declined, or canceled if we reasonably suspect:

  • Fraud;

  • Identity theft;

  • Unauthorized payment activity;

  • Account compromise;

  • False billing information;

  • Address manipulation;

  • Promotion abuse;

  • Chargeback abuse; or

  • Other unlawful or suspicious activity.

We may request reasonable verification information before processing a suspicious order.

We will not request complete account passwords or full payment-card numbers through ordinary Customer Service communications.

19. Shipping and Delivery

Shipping destinations, processing estimates, delivery estimates, costs, tracking procedures, and other shipping conditions are governed by our Shipping Policy and the information displayed during checkout.

Orders may require production time because many products are made to order.

The shipping options displayed during checkout are the available options for that order.

Trendy Best Gifts does not offer express or expedited shipping unless an express or expedited option is specifically displayed and selected during checkout.

Delivery dates are estimates unless we expressly provide a written delivery guarantee.

Delivery may be affected by:

  • Carrier delays;

  • Severe weather;

  • Natural disasters;

  • Transportation interruptions;

  • Customs processing;

  • Labor disputes;

  • High seasonal volume;

  • Incorrect addresses;

  • Failed delivery attempts;

  • Government actions;

  • Supply interruptions; or

  • Other circumstances beyond our reasonable control.

When we cannot ship within the promised timeframe, we will provide notice and available options as required by applicable law. Those options may include accepting a revised shipping date or canceling the affected unshipped order for a refund.

20. Shipping Addresses

You are responsible for entering a complete and accurate shipping address.

Review the shipping address carefully before submitting an order.

We are not responsible for delays, nondelivery, loss, or additional charges caused by:

  • An incorrect address submitted by the customer;

  • An incomplete address;

  • A missing apartment or unit number;

  • A customer’s failure to retrieve a package;

  • A customer’s refusal of delivery;

  • An unauthorized address change;

  • An inaccessible delivery location; or

  • A failed delivery attempt.

Contact Customer Service promptly if you discover an address error.

We cannot guarantee that an address can be changed after processing begins.

If a package is returned because of customer-provided address information or failure to accept delivery, additional shipping charges may apply before the order is resent.

21. Risk of Loss and Delivery

Risk of loss and title to a product transfer as provided by applicable law and the terms of the shipping carrier.

A carrier’s tracking status may be used as evidence of delivery, but it does not eliminate rights available under applicable law.

You should promptly notify us if tracking shows delivery but the package cannot be located.

We may ask you to:

  • Confirm the shipping address;

  • Check with household members;

  • Check with neighbors or building management;

  • Contact the carrier;

  • Provide a written statement;

  • File a carrier claim; or

  • Provide other reasonable documentation.

We will evaluate delivery claims based on the available evidence and applicable law.

22. Damaged, Defective, or Incorrect Products

You should inspect your order promptly after delivery.

Contact support@trendybestgifts.com promptly if:

  • An item arrives damaged;

  • An item is defective;

  • The wrong item was delivered;

  • An item is missing;

  • Personalization is incorrect because of our error; or

  • Material portions of the message card are cut off or improperly printed.

Include:

  • Your order number;

  • A description of the problem;

  • Photographs showing the product, packaging, and shipping label when relevant; and

  • Any other information reasonably needed to evaluate the issue.

We may provide an appropriate remedy, such as:

  • Replacement;

  • Repair;

  • Reproduction;

  • Refund;

  • Store credit, when voluntarily accepted; or

  • Another remedy required by law.

23. Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are governed by our Return and Refund Policy.

Unless applicable law provides otherwise:

  • A return must be requested within the stated return period;

  • Products must satisfy the eligibility requirements;

  • Products sent without authorization may not be accepted;

  • Personalized or custom-made products may be excluded;

  • Refunds are generally issued to the original payment method;

  • Original shipping charges may be nonrefundable; and

  • Return-shipping costs or authorized deductions may apply when disclosed in the Return and Refund Policy.

The current Return and Refund Policy is incorporated into these Terms by reference.

If these Terms conflict with the Return and Refund Policy concerning a return or refund, the Return and Refund Policy controls, unless applicable law requires otherwise.

Nothing in these Terms limits consumer rights that cannot legally be waived.

24. Gift Cards

If gift cards are offered, additional terms displayed with the gift card may apply.

Unless prohibited by law:

  • Gift cards are not redeemable for cash;

  • Gift cards may not be used to purchase another gift card;

  • Gift cards must be protected like cash;

  • We are not responsible for unauthorized use of a gift card caused by the purchaser’s failure to protect it; and

  • Gift-card expiration and fee rules will comply with applicable law.

Gift cards must not be used for unlawful, fraudulent, or unauthorized activity.

25. Jewelry and Product Safety

Customers are responsible for reviewing product descriptions, materials, dimensions, care instructions, and safety information.

Jewelry and related products may contain small parts and may create choking, entanglement, or injury hazards if misused.

Products should be kept away from infants and young children unless specifically designed and identified for their use.

Customers with allergies or sensitivities to metals, finishes, adhesives, fabrics, dyes, or other materials should review product information carefully before purchasing or using a product.

Unless expressly stated, we do not represent that every product is:

  • Hypoallergenic;

  • Nickel-free;

  • Lead-free;

  • Suitable for continuous wear;

  • Waterproof; or

  • Appropriate for every customer.

Discontinue use if a product causes irritation, pain, discomfort, or an unexpected reaction.

26. Product Care

Customers should follow any care instructions supplied with a product.

Exposure to water, chemicals, cosmetics, cleaning products, perspiration, extreme heat, impact, improper storage, or ordinary wear may affect the appearance or durability of jewelry and other products.

Damage caused by:

  • Misuse;

  • Improper storage;

  • Unauthorized repair;

  • Failure to follow care instructions;

  • Normal wear and tear; or

  • Accidents

may not qualify as a product defect.

27. Intellectual Property

The Website and its original contents are owned by or licensed to GiftCraft Collective LLC and are protected by applicable intellectual-property laws.

Protected content may include:

  • The Trendy Best Gifts name;

  • Logos;

  • Brand elements;

  • Product-line names;

  • Original message-card wording;

  • Product designs;

  • Photographs;

  • Videos;

  • Audio;

  • Advertisements;

  • Website text;

  • Blog articles;

  • Illustrations;

  • Graphics;

  • Page layouts;

  • Packaging;

  • Downloadable materials; and

  • Other creative content.

You may use the Website for personal, lawful, noncommercial shopping purposes.

You may not, without prior written authorization:

  • Copy or reproduce protected content;

  • Sell or commercially exploit Website content;

  • Create unauthorized derivative works;

  • Remove copyright or trademark notices;

  • Use our branding in a misleading manner;

“Trendy Best Gifts,” associated logos, slogans, product-line names, and identifying brand elements may be trademarks or service marks of GiftCraft Collective LLC.

You may not use these marks in a manner likely to:

  • Cause customer confusion;

  • Falsely imply affiliation;

  • Falsely suggest sponsorship;

  • Misrepresent product origin; or

  • Violate applicable trademark law.

Third-party marks displayed on the Website belong to their respective owners.

Their appearance does not necessarily indicate endorsement, sponsorship, partnership, or affiliation.

29. Product Reviews and User Content

You may be able to submit:

  • Product reviews;

  • Ratings;

  • Photographs;

  • Videos;

  • Testimonials;

  • Comments;

  • Survey responses;

  • Suggestions; or

  • Other content.

You represent that submitted content:

  • Is based on your genuine experience where represented as a review;

  • Is accurate to the best of your knowledge;

  • Is owned by you or used with permission;

  • Does not infringe another person’s rights;

  • Does not reveal another person’s private information without authorization;

  • Is not fraudulent, defamatory, threatening, obscene, discriminatory, or unlawful;

  • Does not contain malware; and

  • Discloses any payment, free product, discount, incentive, employment, family relationship, or other material connection relating to the submission.

You retain ownership of your content.

By submitting content for publication, you grant Trendy Best Gifts a nonexclusive, worldwide, royalty-free license to:

  • Host;

  • Reproduce;

  • Display;

  • Format;

  • Resize;

  • Publish;

  • Distribute;

  • Share;

  • Promote; and

  • Create reasonable adaptations of that content

for operating, improving, and marketing Trendy Best Gifts.

This license continues for content already incorporated into lawful promotional materials, archived materials, or business records.

We may moderate, reject, edit for formatting, or remove content that violates these Terms or applicable law.

We are not required to publish every submission.

30. Feedback and Suggestions

If you voluntarily send an idea, suggestion, or general feedback that is not submitted confidentially under a separate written agreement, we may use it without compensation or obligation.

This provision does not transfer ownership of your preexisting intellectual property and does not authorize us to use confidential information that we expressly agreed in writing to protect.

31. Copyright and Intellectual-Property Complaints

A person who believes Website content infringes their intellectual-property rights may contact:

The notice should include:

  • Identification of the protected work or right;

  • Identification and location of the disputed content;

  • The complainant’s contact information;

This choice of law does not deprive a consumer of mandatory protections available under the laws of the consumer’s state, province, territory, or country of residence.

45. Jurisdiction and Venue

Subject to mandatory consumer rights and jurisdictional protections, legal proceedings relating to these Terms or the Services must be brought in a court of competent jurisdiction located in Philadelphia County, Pennsylvania.

You and GiftCraft Collective LLC consent to the personal jurisdiction of those courts.

Nothing in this section prevents either party from:

  • Exercising rights in another jurisdiction when applicable law requires that jurisdiction.

47. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

48. Severability

The remaining provisions will remain in effect.

Any assignment will remain subject to applicable consumer-protection law.

These Terms and the policies incorporated by reference constitute the entire agreement between you and GiftCraft Collective LLC regarding use of the Services and purchases made through the Website.

They replace prior versions of the Terms concerning the same subject matter.

A separate written agreement for a bulk order, customization project, promotion, or other service may supplement these Terms.

If a separately signed written agreement conflicts with these Terms, the separately signed agreement controls for the subject it addresses.

51. Headings

Section headings are provided for convenience and do not limit or alter the meaning of these Terms.

52. No Third-Party Beneficiaries

Except where expressly stated, these Terms do not create enforceable rights for anyone other than you and GiftCraft Collective LLC.
